Massachusetts uniformly requires pool barriers under 780 CMR Appendix G and 105 CMR 435. Minimum 48-inch barrier, self-closing and self-latching gates. Standards apply identically across all Suffolk County municipalities.
Suffolk County pool fencing follows strict uniform Massachusetts standards. 780 CMR Appendix G (residential pools) and 105 CMR 435.30 (sanitary code) require: barrier at least 48 inches high for pools built after October 2, 1975 (actually 60 inches for post-1975 pools under 105 CMR 435.30, or 4 feet for pre-1975 pools); barrier with no climbable features (no horizontal members within 45 inches of grade; vertical spacing no wider than 3 inches; chain-link mesh no larger than 1.25 inches); gates self-closing and self-latching with latches 54+ inches above grade; openings under 3 inches wide. A house wall can serve as part of the barrier only if any door opening into the pool area has an alarm or self-closing/self-latching mechanism. ASTM F1346-compliant pool covers qualify as alternate barriers. Spas and hot tubs with locking lids meeting ASTM standards may satisfy barrier requirements without separate fencing. Boston Inspectional Services, Chelsea, Revere, and Winthrop building inspectors all enforce identical state standards β municipalities cannot adopt lesser requirements per MGL c. 143 Β§98, but can require stricter under Β§95.
Non-compliant barriers in any Suffolk County municipality: immediate correction order from building inspector, pool use restricted until compliant. Fines $100-$500 per occurrence. Unpermitted pool without barrier: stop-work order plus triple retroactive permit fees. Civil liability exposure for child-drowning negligence.
