The fence and gates must be 5 feet (1525 mm) in height above the walk grade level and constructed of minimum #9 gauge woven wire mesh corrosion-resistant material. All fence openings or points of entry into the pool enclosure must be equipped with gates. All gates must have self-closing and self-latching devices placed at the top of the gate and made inaccessible to small children. All fence posts must be decay-resistant or corrosion-resistant and set in concrete bases. An express permit for fence work is required to install any pool fence greater than 5 feet.
Failure to provide required pool fencing is a building code violation subject to fines and enforcement by the Department of Buildings. Inadequate fencing may also create premises liability for the property owner in the event of an injury.
