Chapter 43 (Pool and Spa Safety) and the adopted 2018 ISPSC require a permanent barrier at least 48 inches high surrounding any pool or spa capable of holding more than 24 inches of water, including above-ground pools. Barriers must have no gaps greater than 4 inches. No climbable objects may be within 4 feet of the barrier. Gates must be self-closing, self-latching, and swing inward (away from pool). Gate latches must be at least 54 inches above ground or on the pool side if lower. Chain-link fences are prohibited for new pool enclosures constructed after January 1, 1994; non-climbable materials (solid wood, metal, mesh) are required. The barrier must be at least 20 inches from the water's edge and 36 inches from pool equipment. Doors from home to pool area require keyless deadbolts at least 36 inches high and pool alarms.
Non-compliant barrier: correction order. Pool cannot be filled until barrier inspection passes. Fines ranging from $200 to $1,000 per day for ongoing non-compliance.
