Tomball requires safety barriers around all residential swimming pools in compliance with the International Residential Code. Pool barriers must be at least 48 inches high with self-closing, self-latching gates. The barrier must prevent unsupervised access by young children. A final barrier inspection is required before the pool can be filled and used.
Tomball adopts the International Residential Code (IRC) Appendix G for swimming pool barriers and safety. All residential pools, spas, and hot tubs capable of holding more than 24 inches of water must be completely enclosed by a barrier (fence, wall, or combination) at least 48 inches high measured from the exterior side. The barrier must not have openings, handholds, or footholds that would allow a young child to climb through or over. Gaps between vertical members must not exceed 4 inches. Chain-link fencing must have openings no larger than 1.75 inches (standard 11-gauge or heavier). Gates in the barrier must be self-closing and self-latching with the latch located at least 54 inches above the ground on the pool side, or equipped with a lock or key-operated mechanism. Gates must open outward (away from the pool). If the house wall forms part of the barrier, doors opening directly to the pool area must be equipped with self-closing devices and alarms or be protected by a safety cover meeting ASTM F1346. Above-ground pools with walls at least 48 inches above grade may use the pool wall as the barrier provided the access ladder or steps are removable or lockable. Pool covers used as part of the barrier system must meet ASTM F1346 for safety covers.
Failure to install required pool barriers is a serious safety violation. Code enforcement may issue a notice requiring compliance within a specified period, typically 10 to 30 days. Fines up to $500 per day may apply. The city may prohibit use of the pool until barriers are installed and pass inspection. In cases of imminent danger, the city may seek emergency court orders.
