Deer Park mandates pool barriers for all residential swimming pools, spas, and hot tubs in accordance with the International Swimming Pool and Spa Code and the International Residential Code as adopted by Texas. The barrier must be at least 48 inches in height measured from the finished grade on the outside of the barrier. The barrier must completely enclose the pool area with no openings, gaps, or voids greater than 4 inches that would allow a small child to pass through. Chain-link fencing, if used, must have a maximum mesh size of 1.75 inches (diamond pattern). Horizontal rails, bracing, and decorative elements must be spaced so they do not provide a climbing surface; the bottom horizontal rail must be no more than 4 inches above grade. All gates must be self-closing and self-latching, with the latch mechanism located at least 54 inches above grade on the pool side of the gate (or enclosed by a separate mechanism preventing child access). Gates must open away from the pool. If the dwelling wall serves as part of the pool barrier, any doors providing direct access to the pool area must be equipped with a self-closing device and an audible alarm or a lock at least 54 inches above the floor. Above-ground pools with walls at least 48 inches above grade may use the pool wall as the barrier, but the access ladder or steps must be removable or equipped with a lockable gate. The pool barrier inspection is a required step before the pool receives final approval.
Failure to maintain a compliant pool barrier is a code violation subject to fines up to $500 per violation. Code Enforcement may issue a notice requiring correction within a specified timeframe. Pools with non-compliant barriers may be required to be drained and covered until the barrier is brought into compliance. Liability for drowning or injury in an improperly fenced pool may result in civil penalties.
