All residential swimming pools in Baytown must have a safety barrier at least 48 inches high with self-closing, self-latching gates per the International Residential Code and city ordinances. The barrier must be in place and pass inspection before the pool is filled. Gate latches must be at least 54 inches above grade on the outside or located on the pool side of the gate at least 3 inches below the top.
Baytown enforces pool barrier requirements consistent with the International Residential Code (IRC) Appendix G as adopted by the state. Every outdoor residential swimming pool, including in-ground, above-ground, and on-ground pools, must be enclosed by a barrier at least 48 inches high measured on the exterior side. The barrier must not have openings, handholds, or footholds that could allow a small child to climb. For chain link fencing, the mesh size must not exceed 1.75 inches. Horizontal rails or decorative elements must be on the pool side only. Vertical spacing between slats must not exceed 4 inches. All gates must be self-closing and self-latching with the latch located at least 54 inches above the bottom of the gate on the outside, or at least 3 inches below the top of the gate on the pool side with the gate opening outward from the pool. The barrier cannot have gaps at the bottom greater than 4 inches from grade. If the house wall serves as part of the barrier, all doors leading to the pool area must have self-closing devices and alarms that sound when the door is opened. Above-ground pools with sides at least 48 inches high may use the pool wall as the barrier if the ladder or steps are removable and secured when not in use. The barrier must pass a final inspection by the Building Division before water is added. Pool covers are not accepted as a substitute for fencing in Baytown.
Pool barrier violations are treated as life-safety issues. Property owners may receive a notice requiring correction within 24 to 48 hours for imminent hazards. Fines range from $250 to $500 per day for continued non-compliance. The city may require the pool to be drained if no adequate barrier is installed within the correction period.
