La Porte requires safety barriers around all residential swimming pools in accordance with the International Residential Code Appendix G as adopted by the city. Fencing must be at least 48 inches high with self-closing, self-latching gates. The barrier requirements apply to in-ground, above-ground, and hot tub/spa installations that can hold water 24 inches or deeper.
La Porte enforces pool barrier requirements consistent with the International Residential Code (IRC) Appendix G. All swimming pools, hot tubs, and spas capable of holding water 24 inches or deeper must be enclosed by a barrier at least 48 inches high measured from the exterior side. The barrier must not have openings, handholds, or footholds that would allow a child to climb it. Spacing between vertical members must not exceed 4 inches. Chain-link fencing used as a barrier must have a mesh size no greater than 1.75 inches measured diagonally. All gates in the barrier must be self-closing and self-latching, with the latch located at least 54 inches above the ground on the exterior side, or equipped with a key lock or combination mechanism. Gates must open outward away from the pool. If the house wall forms part of the pool barrier, doors with direct access to the pool area must be equipped with self-closing devices and audible alarms or must have the pool side of the door protected by a compliant barrier. Above-ground pools with sides 48 inches or higher may use the pool structure itself as the barrier if the ladder or entry point has a lockable gate or removable steps. Pool covers are not accepted as a substitute for barrier fencing. Hot tubs and spas with lockable safety covers meeting ASTM F1346 may be exempt from the barrier requirement when the cover is secured.
Failure to maintain required pool barriers is a safety code violation. The city may issue a notice requiring compliance within a specified time frame. Fines can reach $500 per day for each day the violation continues. In cases of imminent danger (no barrier around an accessible pool), the city may require the pool to be drained or fenced on an emergency basis. Pool permits will not receive final approval without passing the barrier inspection.
