Public pools, spas, and hot tubs in Cumberland County (hotel, motel, condo, club, campground, camp) must hold an annual DHHS license under 22 MRS Ch. 562 and meet the Maine Health Inspection Program Public Pool and Spa Rules (Chapter 202). Private residential pools have no state safety inspection — owner responsibility under MUBEC.
Under 22 MRS § 2492, no person may operate a public pool or spa in Maine without a license from the Maine DHHS Health Inspection Program. The implementing rule is 10-144 CMR Ch. 202 (Public Pool and Spa Rules), which sets water-quality standards (free chlorine, pH, cyanuric acid, bromine ranges), required test frequency, anti-entrapment drain covers (Virginia Graeme Baker Pool & Spa Safety Act, 15 USC § 8003), depth markings, lifeguard/no-lifeguard signage, and emergency equipment (shepherd's hook, ring buoy, telephone). Inspections are performed annually before opening and unannounced during the season. Cumberland County does NOT inspect pools — DHHS inspectors and, in some jurisdictions, local health officers acting under 22 MRS § 2499 perform inspections. Residential pool safety is not state-inspected; owners are responsible for compliance with 2021 IRC § R326 and Appendix G barrier rules. Maine's general disorderly-conduct statute (17-A MRS § 501-A) and the common law of attractive nuisance can create liability for owners who fail to secure a pool.
Public pool license violations: civil penalty up to $1,000 per day under 22 MRS § 2498; DHHS may suspend or revoke the license under § 2500 and order the facility closed. Operating without a license is a Class E crime. Drain entrapment violations are independently enforceable under federal VGB law (CPSC). Residential owner negligence claims fall under common-law attractive nuisance and Maine wrongful-death (18-C MRS § 2-807).
