Lake Harbor is an unincorporated community (population 49) in Palm Beach County, Florida. Because Lake Harbor is not an incorporated city, it does not have its own municipal code. FL Residential Swimming Pool Safety Act requires every residential pool in PBC to have at least one approved safety feature in addition to a barrier: pool cover, exit alarms, self-closing doors, or pool alarm. VGB-compliant anti-entrapment drain covers are mandatory on all pools and spas.
FL §515.27 requires owners to install at minimum one of four safety features: (1) ASTM F1346-compliant safety pool cover, (2) all doors and windows providing direct access from home to pool equipped with exit alarms with minimum 85 dB sound at 10 feet, (3) all doors providing direct access to pool self-closing and self-latching with release at least 54 inches above floor, or (4) Underwriters Laboratories-listed pool alarm. The federal Virginia Graeme Baker Pool and Spa Safety Act requires anti-entrapment drain covers and, for single-drain pools, a secondary anti-entrapment system.
Failure to maintain safety features: misdemeanor under FL §515.29. Non-VGB drain cover: federal violation, civil penalty up to $1,800. Drowning incident at non-compliant pool: civil liability and possible negligence claims.
