Florida's Residential Swimming Pool Safety Act (FS 515.27) requires every new residential pool to have at least one approved safety feature: a barrier, an approved safety cover, exit alarms on doors/windows, self-closing self-latching doors, or a pool alarm.
FS 515.27(1) says a residential pool must meet at least one requirement: (a) isolated by a barrier meeting FS 515.29; (b) an approved safety pool cover; (c) all doors and windows with direct pool access equipped with an exit alarm rated at least 85 dB A at 10 feet; (d) all such doors fitted with a self-closing, self-latching device with the release no lower than 54 inches above the floor; or (e) a pool alarm meeting ASTM F2208. Public and community pools in the county are separately regulated by the Florida Department of Health under FAC 64E-9.
A person who fails to equip a new pool with a required safety feature commits a second-degree misdemeanor under FS 515.27(3); local code enforcement can also cite the property.
