ADPH's Public Swimming Pool Rules at Chapter 420-3-23 require permits for operation, regular bacteriological and chemical water testing, life-saving equipment, depth markers and no-diving warnings, anti-entrapment drain covers compliant with the Virginia Graeme Baker Act, and enclosed barriers. Pools at apartments, hotels, resorts, schools, and HOAs are covered. Lifeguard requirements apply where water depth exceeds five feet or based on bather load. The Department conducts inspections and may close noncompliant pools. These rules apply uniformly; municipal pool ordinances cannot supersede the public health code.
