Florida's Residential Swimming Pool Safety Act (FS 515.27) requires every new residential pool to have at least one approved safety feature β a 4-foot barrier, an approved safety cover, exit alarms on doors and windows, self-latching doors, or an ASTM pool alarm β before final inspection.
FS 515.27 governs residential pools statewide, including unincorporated Collier County. To pass final inspection and receive a certificate of completion, the pool must meet at least one of five safety options: (a) an enclosing barrier meeting FS 515.29; (b) an approved safety pool cover; (c) exit alarms on all doors and windows with direct pool access; (d) self-closing, self-latching doors with the release 54 inches above the floor; or (e) a swimming pool alarm meeting ASTM F2208. Failing to provide any feature is a criminal offense, though a first-time violator can avoid penalty by installing a feature and completing a drowning-prevention program within 45 days.
A person who fails to equip a new residential pool with at least one required safety feature commits a second-degree misdemeanor under FS 515.27(2).
