Unlike some neighboring states, Oregon has not enacted a statewide ban on menthol cigarettes or flavored vapor products. Multnomah and Washington counties adopted local flavor restrictions, but the Multnomah ordinance was challenged and the Oregon Supreme Court in 2024 considered preemption issues. ORS 431A.190 gives local public health authorities power to enact stricter tobacco rules so long as they do not conflict with state minimum standards. The Oregon Health Authority continues to study flavored product regulation, and OAR 333-015-0078 imposes packaging restrictions intended to reduce youth appeal statewide.
