New Jersey prohibits retail sale of flavored electronic smoking devices and liquid nicotine under P.L. 2019, c.487, restricting most non-tobacco flavors statewide with limited vapor lounge exceptions.
Effective April 2020, New Jersey enacted one of the broadest flavored vape sales bans in the country. The law, codified in connection with NJSA 26:3D and NJSA 54:40B, prohibits retailers from selling any electronic smoking device or liquid nicotine product with a characterizing flavor other than tobacco. Exceptions exist for state-licensed vapor lounges that meet operational and licensing criteria. The ban does not apply to flavored combustible cigars or menthol cigarettes, which remain regulated under separate provisions. Department of Health and local health agencies enforce the ban through inspections and compliance checks.
Retailers selling prohibited flavored vapor products face civil penalties of $250 for first offense, $500 for second, and up to $1,000 for repeat violations, plus license consequences.
