DRMC chapter 24 (Health and Sanitation) requires any Denver business selling cigarettes, cigars, smokeless tobacco, hookah, electronic vapor devices, or e-liquid to hold a Tobacco Product Retailer (TPR) license issued by the Denver Department of Public Health & Environment (DDPHE). Licenses are annual and require zoning verification, age-21 compliance acknowledgment, and DRMC 24-401 flavor-ban acknowledgment. State law adds a Cigarette, Tobacco, and Nicotine Products License under C.R.S. 44-7-103 administered by the Colorado Department of Revenue, which collects state excise taxes. Self-service displays of vapor products are prohibited; products must be behind the counter. DDPHE conducts compliance checks; new applications are denied within 1,000 feet of K-12 schools.
Selling tobacco or vapor products without a Denver TPR license violates DRMC chapter 24 with fines up to nine hundred ninety-nine dollars per offense, license suspension or revocation, and product seizure by DDPHE inspectors.
