For a diseased or hazardous protected tree, the applicant must submit documentation substantiating the condition, and the Director approves, conditionally approves, or denies the application within ten working days. Approved removals require replacement trees per the ordinance formula (two 24-inch-box natives per 10-inch diameter increment for oaks/natives; one for other mature trees), with up to 50% allowed off-site or via in-lieu payment set by a certified arborist. Street/parkway trees are City-owned and handled by Public Works, not via this private-tree permit. Exemptions include emergencies, fruit trees, non-native palms, and dead wood.
Removing a protected tree without the required permit results in an administrative citation, doubled replacement trees, a Stop Work Order if tied to construction, and a one-year ban on future construction permits for removals not tied to construction, all under AMC 23.12.170.
