There is no county tree-preservation permit for removing trees on private, unincorporated land. The binding vegetation-control duty comes from Idaho's Noxious Weed Law: under Idaho Code 22-2407, it is the duty of all landowners to control noxious weeds on their property at their own cost. Ada County administers this through its Noxious Weed Control program (Ada County Code Chapter 8) and a county weed superintendent, who may serve notice to a landowner and, on non-compliance, control the weeds and bill the owner. Designated weeds must be prevented, eradicated or contained. City street-tree and protected-tree rules apply separately inside city limits.
Failing to comply with a weed-control notice can be a misdemeanor (up to $1,000 fine and/or 6 months); the county may treat the weeds and charge the owner, with unpaid costs becoming a property lien.
