Chapter 453 of the Paramus Borough Code authorizes the Shade Tree and Parks Commission to require any person who removes or destroys a tree in violation of the ordinance to pay a replacement assessment to the municipality. The assessment equals the value of the tree as determined by appraisal, which may be calculated using a formula based on the number of square inches in a cross section of the trunk multiplied by a predetermined value per square inch, not to exceed $27 per square inch. This replacement assessment is in addition to any fine imposed by the municipal court, which ranges from $200 to $1,500.
