Borough Code Chapter 291 makes property owners and contractors responsible for replacing any shade tree that does not survive during the one-year period following completion and Borough acceptance of a construction or improvement project. Owners and tenants must also maintain shade and ornamental trees, hedges, and other plantings on private property so the lowest branches overhanging a sidewalk are at least 14 feet 6 inches above ground. The Mayor and Council and Police Department may issue 10 days' written notice ordering corrective trimming, removal, or replacement.
Failure to replace or maintain may trigger 10-day written notices, Borough corrective work at the owner's expense, and Chapter 291 fines.
