Bergenfield Chapter 116 requires property owners to cut brush, hedges, and other plant life near roadways to maintain visibility, with enforcement by the Department of Public Works after written notice.
Under Chapter 116, owners and tenants must keep brush, hedges, and other plant life within 10 feet of any roadway and within 25 feet of intersections cut to no more than 2 1/2 feet in height. Compliance must be achieved within 10 days after written notice. If not addressed, the Borough may cause cutting and removal under the Superintendent of Public Works and bill the property owner. Property maintenance provisions also require that exterior premises be kept free from weeds or plant growth exceeding eight inches.
Failure to comply after written notice results in penalties not exceeding $25, with each day of continued noncompliance constituting a separate offense. The Borough may also perform the cutting and bill the owner for costs.
