Borough Code § 186-45J through L spell out when a fence permit is needed and what it costs. Any fence erected, altered, or reconstructed at a height of more than two feet six inches above grade requires a permit from the Construction Official, and that permit cannot issue without prior approval from the Zoning Officer confirming the fence meets the chapter's height, corner-visibility, and material rules. The flat fee for a new fence permit, or for a permit covering repair of an existing fence, is $50.

Applications must be filed on forms furnished by the Construction Code Department and must be accompanied by a sketch on a copy of the property survey showing the proposed location and dimensions of the fence, so the department can check setbacks, corner sight triangles, and property-line placement before approving the work. Fences at or below two feet six inches are exempt from the permit requirement, but the underlying height, material, and maintenance rules of § 186-45 still apply regardless of permit status. The permit process ties directly to the section's enforcement mechanism: if the Construction Official later finds a fence, permitted or not, in an unsafe or deteriorated condition, the owner receives written notice and 15 days to repair or remove it.
