Fair Lawn requires replacement plantings or contributions to a tree fund when permitted trees are removed, with ratios based on size.
When a regulated tree is removed under a Chapter 200 permit, the property owner is generally required to replace it with one or more new trees of approved species and minimum caliper. Replacement ratios increase with the size of the removed tree, and larger heritage-grade specimens may require multiple replacements. Where on-site replanting is impractical, the borough may accept payment into a tree replacement fund used for public plantings. The Shade Tree Commission approves species and locations.
Failure to plant required replacements or pay tree fund contributions can result in fines and liens against the property.
