Fair Lawn enforces pool barrier rules through Chapter 425 zoning provisions and the New Jersey Uniform Construction Code. Every private swimming pool capable of holding 24 inches or more of water must be surrounded by a fence or barrier at least four feet in height. Gates must be self-closing, self-latching, and open outward away from the pool. Latches must be located at least 54 inches above the ground. Above-ground pools with fixed ladders may use removable ladders as part of the barrier system. A separate pool permit is required from the Building Department.
Non-compliant pool barriers result in fines up to $1,250, daily continuing penalties, and orders to drain the pool until compliance is achieved.
