Swimming pool barriers in Hackensack must comply with the New Jersey Uniform Construction Code adoption of the International Residential Code pool barrier provisions. Barriers must be at least 48 inches high measured from the outside, with no openings allowing passage of a 4-inch sphere. Gates must be self-closing and self-latching, with the latch positioned at least 54 inches above grade or on the pool side of the gate. Above-ground pools may use the pool wall as part of the barrier if the wall meets height standards and ladders are removable or lockable. Door alarms or pool covers may be required where a dwelling forms part of the barrier. Permits are required prior to pool installation.
Pools without compliant barriers may be ordered drained or fenced. Violations carry fines up to $1,250 and pose serious safety liability for property owners.
