Milwaukee Code Chapter 295 allows density bonuses, height bonuses, and parking reductions in select zoning districts when developers provide affordable units, structured parking, or public open space subject to City Plan Commission review.
Chapter 295 includes targeted bonus provisions in downtown, Park East, and select transit-rich districts. Bonus mechanisms typically increase floor-area ratio or building height in exchange for ground-floor active use, structured parking, public plazas, affordable housing units, or historic facade preservation. Milwaukee does not have a citywide mandatory inclusionary zoning ordinance because of Wisconsin Act 67 limits on rent-related mandates, so bonuses are voluntary incentives. Projects above defined thresholds also undergo Detailed Planned Development review. The City Plan Commission and Common Council Zoning Committee evaluate trade-offs case by case.
Failure to deliver promised bonus features after entitlement can result in stop-work orders, certificate-of-occupancy holds, and revocation of the planned development approval.
