ADU rules in Cass County, ND β also called accessory dwelling unit regulations or granny flat ordinances β cover setbacks, owner-occupancy, parking, and permit requirements.
North Dakota has no statewide ADU mandate. In Cass County, zoning authority for unincorporated areas is delegated to organized townships under NDCC Title 11 (county powers) and NDCC Title 58 (township government). Most rural townships in Cass County have adopted their own zoning ordinances that govern accessory dwelling units, accessory structures, and setbacks. The Cass County Planning Office provides resources to townships but does not enforce a unified ADU code in unincorporated areas. Inside Fargo, West Fargo, and other municipalities, the city zoning code controls.
Cass County does not have a single county-wide ADU ordinance. Township-level zoning ordinances (such as the Rich Township Zoning Ordinance amended March 2018) define principal and accessory structures, lot coverage, and setback requirements within each township's jurisdiction. Property owners outside city limits should contact the Cass County Planning Office and verify which township their parcel is in before adding an accessory dwelling. The Planning Office maintains township resources at casscountynd.gov/our-county/planning. Where no township zoning has been adopted, building safety requirements still apply and a development permit may be required from the County Planner. For parcels inside Fargo, West Fargo, Horace, Casselton, Mapleton, or other Cass County municipalities, the city zoning ordinance controls ADU rules - state preemption does not exist in North Dakota for ADUs. North Dakota has adopted the International Residential Code for residential construction, so any habitable accessory dwelling must meet IRC standards regardless of zoning.
Building an accessory dwelling unit without consulting the applicable township zoning ordinance or obtaining required development and building permits can result in stop-work orders, after-the-fact permitting, or required removal. Townships and the county may issue zoning violation notices.
