Teton County, Wyoming - the home jurisdiction of Jackson Hole, Grand Teton National Park, and the southern gateway to Yellowstone - regulates accessory dwellings as 'Accessory Residential Units' (ARUs) under Section 6.1.11.B of the Teton County Land Development Regulations (LDRs). Only one ARU is permitted per principal dwelling, gross floor area is capped at 1,000 sq ft when accessory to a residential use (850 sq ft when accessory to a non-residential use), the minimum rental term is 90 days, and occupancy is limited to persons employed in Teton County or the property owner's family/non-paying guests. ARUs created on or after June 4, 2018 are deed-restricted as 'Workforce Rental' housing and must be registered and annually requalified with the Jackson/Teton County Housing Department. Properties inside the Town of Jackson are governed by the separate Town of Jackson Land Development Regulations.
Teton County's planning and zoning authority comes from Wyo. Stat. Title 18, Chapter 5 (county Planning and Zoning), and is implemented through the Teton County Land Development Regulations (LDRs) maintained by the Joint Planning Department on jacksontetonplan.com. ARUs are governed by LDR Sec. 6.1.11.B (Accessory Uses - Accessory Residential Unit). Key standards drawn directly from that section: (1) one ARU is allowed per principal dwelling unit; (2) an ARU accessory to a residential use shall not exceed 1,000 sq ft of gross floor area; (3) an ARU accessory to a non-residential use shall not exceed 850 sq ft of gross floor area; (4) a property containing an ARU shall not be subdivided so that the ARU is owned separately from the primary use; (5) the minimum rental period is 90 days; and (6) ARU occupancy is limited to persons employed within Teton County or to family members/non-paying guests of the household occupying the principal dwelling. Each ARU permit issued by the County requires the owner to record a Special Restriction (a deed restriction) against the parcel. ARUs built before June 4, 2018 are subject to the deed restriction recorded at the time of permit; ARUs built on or after June 4, 2018 are required to record a 'Special Restriction for Workforce Rental Housing' that places the unit in the Jackson/Teton County Workforce Rental program administered by the Jackson/Teton County Housing Department under the Housing Rules and Regulations adopted June 4, 2018 (amended 2019 and 2020). Workforce-restricted ARUs cannot be rented above the published Workforce maximum rents and must be leased only to households where at least one adult works at least 30 hours/week for an employer in Teton County, Wyoming. The County operates an annual compliance program: owners submit a Tenant Qualification Packet (and self-employed tenants submit business verification) for each new lease, lease renewal, and Annual Requalification. Renting an ARU as a short-term rental, to a household with no Teton County employment connection, or for less than 90 days is treated by the County as a Short-Term Rental violation under LDR Sec. 6.1.11.B. The County's enforcement remedies include immediate revocation of the ARU permit and a requirement that the owner physically remove the sleeping quarters, kitchen, and bathing facilities so the structure no longer qualifies as a dwelling unit. Tiny homes on wheels and recreational vehicles do not qualify as ARUs. ARUs may be attached to the primary dwelling, located above a detached garage, or built as a free-standing structure, subject to the underlying zone's setback, height, and lot-coverage standards in LDR Articles 2 (Zone Districts) and Article 5 (General Site Standards). Properties inside the corporate limits of the Town of Jackson follow the Town of Jackson LDRs (separate Municode codification on library.municode.com); the Town adopted Ordinance 1139 (Nov. 21, 2016) to allow ARUs in additional residential zones (NC-ToJ, NC-2, S-ToJ, R-ToJ), with size and design standards published in the Town LDRs.
Operating an ARU outside the LDR Sec. 6.1.11.B parameters - including renting for fewer than 90 days, renting to a household with no Teton County employment tie, exceeding 1,000 sq ft (residential) or 850 sq ft (non-residential), maintaining more than one ARU on a single dwelling unit, or failing to comply with the Workforce Rental Special Restriction recorded after June 4, 2018 - is enforced by Teton County Code Compliance under the LDRs and is also subject to the County's separate short-term-rental enforcement. The County's remedies include: (1) written notice of violation, (2) immediate revocation of the ARU permit, (3) civil penalties under the LDR enforcement chapter, and (4) a requirement to remove sleeping quarters, kitchen facilities, and bathing facilities so the structure no longer constitutes a dwelling unit. Workforce-restricted ARUs are also subject to the enforcement provisions of the Jackson/Teton County Housing Rules and Regulations, including loss of qualification status and recorded enforcement actions. Building an ARU without the required zoning compliance verification from the Joint Planning Department or without a building permit from Teton County Building Services is a separate violation under LDR Article 8 (Administration) and the Teton County building-code adoption ordinance. Subdividing a property so an ARU is owned separately from its primary dwelling is prohibited and would also violate Wyo. Stat. 18-5-301 et seq. (county subdivision permit requirements).
