Teton County Wyoming bans virtually all consumer fireworks countywide under Board of County Commissioners Resolution 13-027, adopted pursuant to W.S. 35-10-202. Sparklers are the sole exception. Fireworks are also prohibited inside the Town of Jackson, on Bridger-Teton National Forest land, in Grand Teton and Yellowstone National Parks, and on the National Elk Refuge. Public displays require a special-event permit issued at least 45 days in advance by Jackson Hole Fire/EMS.
Fireworks in Teton County are governed by Wyoming Statutes Title 35, Chapter 10, Article 2 (sections 35-10-201 through 35-10-208), Teton County Board of County Commissioners Resolution 13-027, Town of Jackson Municipal Code Resolution 98-04, and overlapping federal land-management regulations. W.S. 35-10-208 expressly authorizes any Wyoming county to prohibit the sale or use of fireworks within its borders by resolution. Acting under that authority and the general fire-prevention powers in W.S. 35-10-202, the Teton County Commission adopted Resolution 13-027, which makes it unlawful to use or discharge any fireworks anywhere in the unincorporated county. The county website states plainly that 'fireworks are only allowed when permitted through the special event process through either the Town of Jackson or Teton County. Otherwise, the use of fireworks is illegal in Teton County.' The only consumer item that remains lawful is the sparkler, which the county distinguishes from regulated fireworks because of its low-explosion character; users are still warned to handle sparklers carefully. Public fireworks displays (such as the Snow King and Jackson Hole Mountain Resort July 4 shows) operate under special-event permits issued by Jackson Hole Fire/EMS at 40 East Pearl Avenue, Jackson, WY 83001 (307-733-4732). Applications must be submitted at least 45 days before the event, the operator must hold a Wyoming pyrotechnician registration, and crowd-control managers must complete the certification offered through firemarshals.org. Federal lands surrounding Teton County add a second layer of prohibition. 36 CFR Part 261 (National Forest System lands) and the Bridger-Teton National Forest forest-wide order ban discharging or igniting any firework on Bridger-Teton NF and the National Elk Refuge year-round. 36 CFR 2.38 prohibits fireworks in Grand Teton National Park, and 36 CFR 7.13 reinforces the ban specifically for Yellowstone National Park. During Stage 1 or Stage 2 fire restrictions issued by the Teton Interagency Fire Center, even sparklers, charcoal grills, and open flames outside developed areas are added to the prohibition list.
Violation of Teton County Resolution 13-027 is a misdemeanor enforced through W.S. 35-9-304, punishable by a fine of up to $100 or up to 30 days in the county jail, or both. A general violation of the state fireworks article (W.S. 35-10-201 et seq.) is also a misdemeanor and, under W.S. 35-10-207, is punishable by a fine of not more than $750, imprisonment of up to 60 days, or both. Discharging fireworks on Bridger-Teton National Forest land or the National Elk Refuge violates 36 CFR Part 261 and is punishable under 16 U.S.C. 551 by a fine of up to $5,000 for an individual or $10,000 for an organization and/or up to six months in federal prison. Fireworks in Grand Teton or Yellowstone National Parks violate 36 CFR 2.38 and 36 CFR 7.13, with the same federal penalty range. Anyone who starts a wildfire with fireworks may also be billed for full suppression costs and held civilly liable for property damage and injuries.
