Carports are regulated under Hampton's zoning ordinance as accessory structures incidental to a principal dwelling. In multifamily districts, the zoning ordinance expressly excludes attached carports from the minimum dwelling-area calculation (Sec. 5-4), meaning carport square footage does not count toward required habitable area. Detached carports must observe the residential district's accessory structure rules and the rear-yard setback (typically not less than 20 feet in higher-density residential districts). Carports projecting into a required side yard or sight triangle on a corner lot are not permitted. Building permits are issued by Hampton's Codes Compliance office, and the structure must satisfy the Virginia Uniform Statewide Building Code, including wind-load standards for the coastal area.
Carports built without a permit or in violation of setback or height rules receive a code compliance notice. Owners must obtain after-the-fact approval, modify the structure, or remove it. Continued non-compliance results in escalating fines.
