In unincorporated Montgomery County, the county lacks zoning authority (Local Govt Code Ch. 231) and cannot require permits or setback compliance for carports. Subdivision restrictions (deed restrictions enforced via the POA or HOA) are the primary regulation. The City of Conroe Unified Development Code (UDC) classifies carports as accessory structures: building permit required if over 200 sq ft, 5-foot side setback, 25-foot rear setback, cannot exceed height of primary residence, and counts toward the 35% rear-yard lot coverage maximum. Attached carports must meet primary residence setbacks (typically 25-foot front, 5-foot side). Conroe UDC Β§5.04 requires materials compatible with the home β bare metal and corrugated aluminum prohibited in residential districts. The Woodlands Residential Development Standards ban metal or temporary carports in all villages; enclosed garages required for vehicle storage.
