In unincorporated Montgomery County, the county lacks zoning authority (Local Govt Code Ch. 231) and cannot require permits or setback compliance for carports. Subdivision restrictions (deed restrictions enforced via the POA or HOA) are the primary regulation. The City of Conroe Unified Development Code (UDC) classifies carports as accessory structures: building permit required if over 200 sq ft, 5-foot side setback, 25-foot rear setback, cannot exceed height of primary residence, and counts toward the 35% rear-yard lot coverage maximum. Attached carports must meet primary residence setbacks (typically 25-foot front, 5-foot side).
