Utica's Zoning Code defines a carport separately from a garage and treats it as an accessory structure. Like other accessory structures over six feet tall, a carport must be set back from side or rear lot lines a distance equal to its height.
The Zoning Code distinguishes a carport from an enclosed private garage, which it defines as an accessory building for storage of private vehicles. A carport is an open, roofed accessory structure and is subject to the general accessory-structure standards: it must be subordinate to the principal building, and if it exceeds six feet in height it must be set back from any side or rear property line by a distance equal to its height. Structures over 144 square feet require a building permit under City Code Β§ 2-6-51. Placement must also respect the district's yard and lot-coverage requirements in the dimensional tables.
An unpermitted or improperly sited carport violates the Zoning Code; Code Enforcement may order removal, issue fines, or require a variance.
