In Baltimore County a carport is an accessory structure. If it is attached to the dwelling by an open projection such as a deck, porch, or patio, it must meet the principal dwelling setbacks, not the more lenient accessory-building setbacks in BCZR Sections 400.1 and 400.2.
The Baltimore County Zoning Policy Manual (Policy A-7) explains that if an accessory structure such as a garage, shed, pool house, or carport is attached to an existing dwelling by an open projection (deck, porch, patio, or carport), it must meet the principal dwelling setbacks rather than the Section 400.1/400.2 accessory-building setbacks. A freestanding carport is treated as a standard accessory structure, subject to rear-yard location, the 15-foot height limit, 2.5-foot side/rear setbacks, and the 40-percent yard-coverage cap. A permit is required for accessory structures over 120 square feet.
A carport placed within accessory-building setbacks but functionally attached to the dwelling can be cited; the county may require a variance or removal, plus fines.
