New York State prohibits breed-specific legislation under Ag and Markets Law Section 107(5). Saratoga County municipalities cannot ban dogs based on breed.
NY Ag and Markets Law Section 107(5) expressly preempts any local law, ordinance, or rule that bans or restricts dogs based on breed alone. Saratoga Springs, Clifton Park, Halfmoon, Wilton, Malta, and all other Saratoga County municipalities must rely on behavior-based 'dangerous dog' findings under Section 123 rather than breed lists. Pit bulls, Rottweilers, German Shepherds, and other commonly targeted breeds are legal countywide. Insurance companies may still decline coverage by breed; landlords may restrict by breed in rental agreements. Military family housing at nearby Saratoga County locations may still follow federal guidance. HOA covenants in Malta, Clifton Park, and Saratoga Springs subdivisions may restrict breeds contractually.
No breed-based violations possible. Dangerous dog findings under Section 123 can lead to muzzle orders, confinement requirements, or euthanasia in severe cases with $1,000+ fines.
