Schenectady County cannot impose breed bans. NY Agriculture & Markets Law §107(5) preempts all breed-specific legislation statewide. Dangerous dogs are handled case-by-case under §123 regardless of breed.
NY Ag & Markets §107(5) explicitly prohibits any municipality from enacting a law regulating dogs based solely on breed. Schenectady County, its cities, towns, and villages therefore have no pit bull, Rottweiler, or other breed-specific bans. Dangerous-dog proceedings under §123 apply to any dog that has attacked or posed a threat, subject to hearings in town or village court. Landlords and insurers may still restrict breeds as a private matter.
No breed-based fines possible. Dangerous-dog findings may require muzzling, confinement, or euthanasia.
