Nevada law preempts breed-specific bans. Under NRS 202.500, neither Sparks nor Washoe County may declare a dog dangerous or vicious based solely on its breed. Dangerous-dog rules are behavior-based, not breed-based.
Nevada bars breed-specific legislation statewide. NRS 202.500 provides that a dog may not be found dangerous or vicious based solely on its breed, and that a local authority may not adopt or enforce an ordinance deeming a dog dangerous or vicious by breed. Sparks and Washoe County therefore have no pit-bull or other breed ban. Dangerous- and vicious-dog designations turn on behavior: a dog is dangerous after two unprovoked menacing incidents within 18 months, and vicious if it kills or inflicts substantial bodily harm on a person, or continues dangerous behavior after notice. Owners of designated dogs face containment requirements, and a vicious-dog attack can be a category D felony. Private HOA CC&Rs may still restrict breeds.
Keeping a dog known to be vicious can be a misdemeanor, escalating to a category D felony if the vicious dog causes substantial bodily harm. Courts may order containment or humane destruction.
