Yellowstone County does not ban specific dog breeds. Instead, Montana law lets the county control any 'vicious dog' by ordinance, defined by behavior, not breed. A dog that bites or attacks may be regulated, quarantined, or destroyed regardless of breed.
Montana counties regulate dangerous dogs by conduct, not breed. Under MCA 7-23-2109 the county may 'regulate, restrain, control, kill, or quarantine any vicious dog, whether licensed or unlicensed.' A vicious dog is one that bites or attempts to bite a person without provocation, or that harasses, chases, bites, or attempts to bite another animal. There is no county pit-bull or breed-specific ban. Any breed can be declared vicious based on its behavior. Incorporated towns may add their own dangerous-dog procedures.
Violation of a vicious-dog ordinance is a misdemeanor; the county may impound, quarantine, or destroy the dog under MCA 7-23-2109.
