The City of Erie does not have a stand-alone municipal lead ordinance equivalent to Reading Chapter 328. Lead hazards in Erie are addressed through the federal Residential Lead-Based Paint Hazard Reduction Act (42 U.S.C. Section 4851), EPA's Renovation, Repair and Painting Rule (40 CFR Part 745), Pennsylvania's Lead Certification Act (35 P.S. Section 5901), and the Erie County Department of Health LeadSAFE program enforced under the Erie County Sanitary Code.
Three regulatory layers govern lead paint in Erie. (1) Federal - the Residential Lead-Based Paint Hazard Reduction Act (Title X, 42 U.S.C. (2) State - the Pennsylvania Lead Certification Act of 1995 (35 P.S. Sections 5901 et seq.) requires lead inspectors, risk assessors, and abatement contractors to be Pennsylvania-certified. (3) Local - the Erie County Department of Health (ECDOH) operates the LeadSAFE Erie County program, the Childhood Lead Poisoning Prevention Program (CLPPP), and the Lead Poisoning Primary Prevention Program (CLPPPP). When presumed or confirmed paint hazards are identified, remediation is ordered via enforcement of the Erie County Sanitary Code. The Redevelopment Authority of the City of Erie also operates a federally funded Lead Hazard Control Program offering grants for abatement in qualifying owner-occupied and rental units. Erie is a high-priority lead jurisdiction because the majority of its housing stock predates 1950 and contains lead-based paint. Erie's Residential Rental Registration program (Article 330) incorporates lead-hazard inspection into bi-annual rental housing inspections.
Federal Lead Disclosure Rule violations carry civil penalties up to $19,507 per violation (2024 inflation-adjusted) under HUD/EPA enforcement, plus treble damages payable to the tenant or buyer under 42 U.S.C.
