Under Erie's Zoning Ordinance Section 204.19, fences, hedges, and enclosures within required yard space may not exceed 6 feet 6 inches in residential districts or 8 feet 6 inches in non-residential districts. Height is measured from the maximum grade level on either side of the property.
Fence heights are controlled by the City of Erie Zoning Ordinance (Ord. 80-2005), Article 2, Section 204.19. In a residential district the maximum is 6'6"; in a non-residential district the maximum is 8'6". Where a boundary line runs between districts, the less restrictive 8'6" height applies on that line. Height is measured from the maximum grade level on either side of the property to the top of the fence, so retaining walls or graded slopes cannot add hidden height. Any enclosure may be placed up to, but not exceed, the property line. Security fencing around a communications-equipment building must have openings under nine square inches and stand 6 to 8 feet tall.
A fence exceeding the 6'6" residential or 8'6" non-residential cap, or erected without the required fence permit, is a zoning violation. The Zoning Officer can order it shortened or removed and issue citations under the City Code.
