After Ohio Issue 2 passed in November 2023, the Division of Cannabis Control implemented ORC Chapter 3780 governing adult-use cannabis. ORC 3780.20 mandates dispensaries cannot be located within 500 feet of a school, church, public library, public playground, or public park. Distance is measured from the dispensary entrance to the nearest property line of the protected use. Toledo zoning further restricts dispensary siting to commercial and industrial districts and prohibits clustering. Existing medical dispensaries grandfathered under the prior medical program may operate dual-use under DCC certification. Local control over hours, signage, and additional buffers is preserved by ORC 3780.25.
Operating a dispensary within the 500-foot buffer or without DCC license can trigger state license revocation, civil penalties, and Toledo zoning enforcement including business license suspension.
