Ohio Issue 2 (2023) legalized recreational cannabis dispensaries, which began adult-use sales in August 2024. Toledo has allowed existing medical dispensaries to add adult-use sales and regulates dispensary zoning under TMC land use provisions.
Under Ohio Issue 2 adult-use cannabis sales began August 6, 2024 at licensed dispensaries. Existing medical cannabis dispensaries (licensed under the former Medical Marijuana Control Program) were given priority to add adult-use licenses. Ohio Division of Cannabis Control (Department of Commerce) issues licenses. State law permits municipalities to ban or limit dispensaries within their jurisdiction by local ordinance. Toledo has allowed existing medical dispensaries (such as those operating pre-2024) to transition to dual-use. Zoning requires dispensaries typically to be in commercial or specific overlay zones, with minimum separation distances (often 500 feet) from schools, churches, playgrounds, and substance abuse treatment facilities under state rules. No smoking or consumption on dispensary premises. Buffer and signage rules apply. Cities cannot ban personal use or home grow, only commercial operations.
Operating dispensary without state license and local zoning approval: state and local enforcement, substantial penalties. Consumption on-site: state violation.
