Ohio voters approved Issue 2 (the Ohio Cannabis Rights and Regulations Initiative) on November 7, 2023, making Ohio the 24th state to legalize recreational cannabis. The law took effect December 7, 2023 and is codified at ORC Chapter 3780. Adults 21 and older may possess up to 2.5 ounces of cannabis flower and 15 grams of extract, and may cultivate up to 6 plants per adult with a maximum of 12 plants per household regardless of number of adults. Cultivation must occur at the adult user's primary residence in a secure area not visible from public spaces and not accessible to minors. Plants grown outdoors must be in an enclosure. Toledo has not adopted local restrictions beyond state law; home grow is legal consistent with Issue 2. Landlords may prohibit cultivation in rental agreements. Federal law still prohibits cannabis (Schedule I).
