OCM-licensed retail dispensaries and microbusinesses may deliver adult-use cannabis to Suffolk County residents subject to state delivery rules. Towns that opted out of dispensaries still allow lawful delivery from licensees elsewhere.
Under New York Cannabis Law and OCM regulations, licensed adult-use retail dispensaries and microbusinesses may operate delivery to consumers 21 and older. Deliveries must be by licensee employees, in approved vehicles, with required ID checks, manifests, and limits on cash on hand. Suffolk County towns that opted out of hosting dispensaries cannot block delivery from licensees located elsewhere; the opt-out only restricts in-town storefronts. Unlicensed delivery, including out-of-state operators and gray-market services, is prohibited and subject to OCM enforcement. SCPD and town police may also enforce against unlicensed operations.
Unlicensed delivery, sales to anyone under 21, missing manifests, or operating outside authorized hours can lead to OCM license action, fines, vehicle impoundment, and criminal charges.
