Recreational and plant-form marijuana dispensaries are illegal in Iowa. Only a handful of state-licensed medical cannabidiol dispensaries operate statewide under Iowa Code chapter 124E, so there is no local dispensary market to zone.
Iowa authorizes no recreational cannabis stores and no ordinary medical-marijuana dispensaries. The only lawful outlets are the limited medical cannabidiol dispensaries licensed by Iowa Health and Human Services under Iowa Code chapter 124E, which sell low-THC products to registered patients and are capped in number statewide. Because the state controls that program, a city or Johnson County cannot create or license a marijuana dispensary, and any unlicensed cannabis sales operation faces felony prosecution under Iowa Code section 124.401. Hemp-derived CBD products containing less than 0.3 percent THC are sold through ordinary retail channels and are not part of the medical program.
Operating an unlicensed cannabis dispensary is criminal, not a zoning matter, and can be charged as delivery or possession with intent under Iowa Code section 124.401, with property used for sales subject to forfeiture.
