Full Breakdown

24(CC) makes short-term rental of a single-family dwelling, auxiliary dwelling unit, seasonal home, cabin, or individual unit in a multi-family dwelling an accessory use in the A, AR, SF, RS, RM, RC, and AG-T districts, but only with Zoning Administrator approval. 27's permitting procedure, and every permit expires two years after issuance, at which point the operator must reapply; the Zoning Administrator can attach special conditions to any approval to protect public health, safety, and welfare. The unit must be rented in its entirety: subsection (CC)(2) bars renting on a room-to-room basis, so a homeowner cannot lease individual bedrooms separately under this permit.

Any structure where the visiting public congregates must meet Chapter 8:6's building code, and the operation must comply with Johnson County Public Health requirements and other applicable federal, state, and local regulations. Subsection (CC)(6) requires the rental to be managed so as to protect the health, safety, and welfare of renters and the public, preserve property values, and avoid becoming a nuisance; improper management is expressly grounds for permit denial or revocation by the Zoning Administrator. Operators who already hold a Board of Adjustment conditional use permit for a Country Inn or Bed and Breakfast Home do not need a separate short-term rental permit under subsection (CC)(7). 24(E)(5) apply on top of these base permit conditions where relevant.

Violations & Fines

Operating without the Zoning Administrator's permit, letting a permit lapse past its two-year term, renting room-to-room, or mismanaging the property into a nuisance exposes the owner to permit denial or revocation under subsection 8:1.24(CC)(6) and to Chapter 8:8 enforcement, including a county infraction citation carrying a civil penalty up to $750 for a first offense and $1,000 for a repeat offense.

Frequently Asked Questions

How long does a Johnson County short-term rental permit last?
Two years from issuance. Subsection 8:1.24(CC)(1) requires the operator to apply for a new permit once the two-year term expires; there is no automatic renewal for short-term rental permits in unincorporated Johnson County.
Can I rent out individual rooms in my short-term rental?
No. Subsection 8:1.24(CC)(2) requires the dwelling to be rented out in its entirety; renting on a room-to-room basis is not allowed under this accessory-use permit for single-family homes, cabins, or seasonal homes.
Does a Bed and Breakfast need a separate short-term rental permit?
No. Subsection 8:1.24(CC)(7) waives the separate short-term rental permit where the Board of Adjustment has already approved a conditional use permit for a Country Inn or Bed and Breakfast Home on the same property.
What can cause the county to revoke my short-term rental permit?
Poor management. Subsection 8:1.24(CC)(6) ties the permit to managing the rental so it protects renter and public health, safety, and welfare and does not become a nuisance; improper management is expressly grounds for denial or revocation.
