Under 7 V.S.A. Section 881, Vermont legalized home cultivation of cannabis statewide in 2018. Each Burlington household, regardless of the number of adult occupants, may cultivate a maximum of two mature plants and four immature plants. Plants must be screened from public view and secured from minors. Renters need landlord consent. Burlington does not impose additional zoning permits on personal home grows, but odor and ventilation must comply with Chapter 21 nuisance standards. Cultivation for sale requires a state retail license through the Vermont Cannabis Control Board.
Exceeding plant limits or growing visibly outdoors can result in civil fines and possible criminal charges under state law for unlicensed commercial cultivation.
