Home cannabis cultivation is legal in New York under the MRTA (Cannabis Law §222). Adults 21 and over may grow up to 3 mature and 3 immature plants for personal use, with a household cap of 6 mature and 6 immature plants regardless of how many adults reside there. Home-grow became active for adults after OCM's implementing regulations took effect in late 2024, though medical cannabis patients certified under the Compassionate Care Act have been allowed to cultivate since earlier rulemaking. Plants must be grown in a location that is not visible from public street view and secured against access by persons under 21. Municipalities, including all Schenectady County jurisdictions, cannot ban home cultivation; state preemption is explicit. Towns may impose reasonable content-neutral rules on things like outdoor grow screening, odor control, and electrical/fire safety for indoor setups. Rental landlords may still prohibit cultivation in leases, and federally subsidized housing bans cannabis under federal law regardless of NY statute.
