Home cultivation of cannabis is illegal in Dunedin. Florida law does not permit any patient, caregiver, or recreational user to grow marijuana plants at home; only state-licensed Medical Marijuana Treatment Centers may cultivate cannabis.
Florida's Compassionate Use Act and the constitutional medical marijuana amendment do not authorize home cultivation. Under Florida Statute Chapter 381 and Department of Health rules, only licensed Medical Marijuana Treatment Centers (MMTCs) are permitted to grow, process, and dispense cannabis. Possession of any growing plant remains a felony under Florida Statute 893.13, regardless of medical card status, and the November 2024 recreational ballot measure (Amendment 3) failed to reach 60% approval. Dunedin has no separate cultivation ordinance because state law fully preempts the topic, and any home grow can be prosecuted in state court with potential parallel city code action for related nuisances.
Cultivating cannabis is a third-degree felony in Florida (up to five years prison and $5,000 fine). Possession of 25 or more plants triggers trafficking-level mandatory minimum sentences.
