Florida Statute 381.986 governs the medical marijuana program and confines cultivation to vertically integrated Medical Marijuana Treatment Centers (MMTCs) licensed by the Office of Medical Marijuana Use. Recreational cannabis remains illegal in Florida as of 2026, and even qualified medical patients cannot legally grow cannabis at home. Seminole has no separate ordinance authorizing home grow because it would conflict with state law. Possession of unlicensed cannabis plants is a felony under FS 893.13 with penalties scaling by plant count.
Cultivation of 25 or more plants is a third-degree felony with up to 5 years prison; 300+ plants triggers minimum mandatory sentencing.
