Euless, TX Cannabis Regulations: Home Cultivation (2026)

Home cannabis cultivation is flatly illegal in Euless. Texas Health and Safety Code Chapter 481, the Texas Controlled Substances Act, classifies marijuana as a prohibited substance and criminalizes possession, manufacture (including cultivation), delivery, and possession with intent to deliver. There is no city-level authority to permit cultivation because state law preempts local legalization. Possession of any usable quantity of marijuana is at minimum a Class B misdemeanor (up to 180 days in jail and a $2,000 fine) for under 2 ounces, scaling up rapidly for larger amounts; manufacture or delivery charges are felonies. Cultivating plants is considered manufacture under the statute, with penalties tied to the aggregate weight of the plant material, not the number of plants, and often charged as a state jail felony or higher depending on quantity. The Texas Compassionate Use Program (TCUP) allows a narrow category of patients with qualifying medical conditions to purchase low-THC cannabis products from state-licensed dispensaries; TCUP does not permit home cultivation by patients. Hemp products with less than 0.3 percent delta-9 THC are legal under the 2018 federal Farm Bill and Texas Agriculture Code Chapter 122, and industrial hemp cultivation by licensed agricultural producers is allowed, but that is not home gardening of consumable cannabis. Law enforcement in Euless responds to cannabis cultivation complaints and coordinates with state authorities. Federal law also still classifies cannabis as a Schedule I controlled substance.
