Mansfield, TX Cannabis Regulations: Home Cultivation (2026)

Cultivation of cannabis (marijuana) for personal or recreational use is illegal in Mansfield and throughout Texas. Marijuana remains a Penalty Group 1-B and related controlled substance under Texas Health and Safety Code Chapter 481, and cultivation is treated as manufacture or possession with intent to deliver regardless of the number of plants. Under Texas Health and Safety Code 481.120 and 481.121, possession and delivery of usable marijuana are state jail felonies at two ounces or more and range up to first-degree felonies for large quantities. Cultivation and manufacture carry equal or greater penalties. Texas does not have a personal-use medical marijuana program comparable to most states; the Texas Compassionate Use Program (CUP) permits very limited low-THC cannabis (generally 1 percent or less THC) by prescription through licensed dispensing organizations for qualifying conditions, but patients may not grow cannabis at home. Federal law also prohibits cultivation under the Controlled Substances Act. Hemp containing 0.3 percent or less delta-9 THC is legal for licensed agricultural production under Texas Agriculture Code Chapter 122, but home hemp growing for personal use is not authorized outside that licensing framework.
